As we continue to develop our website and implement new technologies it may also become necessary for us to amend this data privacy statement. It is therefore recommend that you read this data privacy statement again from time to time.

Our website uses the tracking pixel technology from WiredMinds GmbH (www.wiredminds.de) to analyse visitor behaviour. This involves processing the visitor's IP address. The data is processed solely for the purpose of collecting company-related information, such as the company name. IP addresses of natural persons are excluded from further use (whitelist method). The IP address is never stored in LeadLab. When processing data, it is in our particular interest to protect the data protection rights of natural persons. Our interest is based on Article 6(1)(f) GDPR. The data we collect does not allow any conclusion to be drawn about an identifiable person at any time.

Applications
You can submit your application by post, by email (personal@kettenwulf.com) or via our careers portal. When you apply to us, we process the information that we receive from you as part of the application process, e.g. your cover letter, CV, certificates, etc. In addition to your contact details, we are particularly interested in information about your education, qualifications, work experience and skills. We will only assess you on your suitability for the role, so you do not need to send us a photo. Your data will initially be processed solely for the purpose of the application process and deciding on an employment relationship. The legal basis for this processing of your personal data is Section 26(1) of the German Federal Data Protection Act (BDSG). If your application is successful, your personal data will become part of your personnel file. Inclusion in the applicant management system? We store all applications for up to six months after the selection process has been completed. After this time, they will be permanently deleted or returned to you in full. If it is evident that the data will be required after expiry of the six-month period, for example due to an (impending) legal dispute, the application will be deleted if it is no longer required for the respective purpose. In the event that we find your application interesting but we are unable to offer you a position at the moment, we will ask for your explicit consent to store your application data in our applicant pool for a longer period of time so that we can consider you for future job openings. In this case, Article 6(1)(a) GDPR is the legal basis for the longer storage period. You can revoke this consent at any time. We store speculative applications for an unlimited period of time and add them directly to our pool of applicants so that we can consider them as soon as a suitable position becomes available. You can object to this storage at any time. Your personal data will only be collected or processed by persons responsible for the application process. If you apply for a job with one of our group companies, your data will be transferred to that company for this purpose. We use the applicant management software “Talentstorm” from ontavio GmbH, Hundemstrasse 2, 57368 Lennestadt, Germany (“Career Portal”) to process and store applicant data. Applicants enter the necessary data in an input screen and upload their application documents via the Career Portal on our website. Before sending the application, it is necessary to submit the declaration of consent for data storage. After the application is sent, it is transmitted to the service provider and transferred to the internal database. Initially, the human resources department has access to this database. By approving the application, they can involve the relevant parties in the company in the selection process.

Contact form
On the "Contact form" page you will be prompted to enter personal data in order to contact us or request information material. We need this information to meet your specific request. You are free to choose whether to enter this information. Your personal data will not be combined or compared with other data; they will only be used for the purpose you intended. If it should be necessary to store such data to provide the service required, your data will be saved on specially protected servers. Before submitting a request you must consent to the storage of your data for information purposes. Any disclosure to third parties is excluded. You can revoke your consent to the storage of data at any time by sending an email to datenschutzbeauftragter@kettenwulf.com.

 

Disclosure of personal data

Data that is logged when you access the KettenWulf Betriebs GmbH website will never be passed on to third parties.

Any personal information you have provided will only be used by us for the purposes that you have agreed to and forwarded within the Kettenwulf group to the department that is responsible for the respective request. No such information will be disclosed to third parties for other purposes.

 

Right of access and right of withdrawal, erasure

You have the right to request information about the data we have stored about you and the purpose of storage at any time. You can withdraw your consent to the storage or use of your personal data in writing at any time.

Legal basis of the processing

Article 6(1)(a) of the GDPR serves as the legal basis for our company for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1)(b) GDPR. The same applies to processing that is necessary to carry out pre-contractual measures, for example in the case of enquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Article 6(1)(c) GDPR.

 

Period for which personal data is stored

The criterion for the duration of the storage of personal data is the respective statutory retention period. After the period has expired, the corresponding data is routinely deleted if it is no longer required for the fulfilment or initiation of the contract.

Online presence on social media

We maintain an online presence within social networks in order to communicate with interested parties and users who are active there and to inform them about us. The service provider may process user data outside the European Union. This may give rise to risks for users, for example by making it more difficult to enforce their rights. The service provider generally processes user data for market research and advertising purposes. For example, the interests of users arising from their usage behaviour can be used to place advertisements inside and outside the platforms that may correspond to the interests of users. This is usually achieved by storing cookies on the users' computers. Furthermore, data can also be stored in the user profiles independently of the devices used (especially if the users are members of the respective platforms and are logged in to them).

We will inform you below about the processing of your personal data by us in the context of the online presences we provide. In its judgment of 5 June 2018, the ECJ confirmed the joint responsibility of service providers and site operators. The social media page you visit offers you the opportunity to react to our posts, comment on them, create a post yourself and send us private messages with personal enquiries. The data you provide in this context and that may be accessible to us (e.g. username, images, interests, contact details) will be used by us exclusively for the purpose of communicating with customers and interested parties. Our interest lies in offering you a platform on which we can display up-to-date information and by means of which you can address your concerns to us and we can respond to your request as quickly as possible. We do not carry out any further data processing besides the basic functions through the site. Please note that the service provider may use tracking tools and cookies, regardless of our use of the site. We would also like to point out that, in the case of requests for information and the assertion of user rights, these can be most effectively asserted with the providers themselves.
